By participating in the Seagate Taiwan Take Back Promotion Program (the “Promotion” or the “Giveaway”), participant (“Participant” or “You”) agree to be bound by these Official Rules.

OPEN ONLY TO LEGAL RESIDENTS OF ONE OF THE COUNTRIES/TERRITORIES LISTED IN APPENDIX A (“ELIGIBLE TERRITORIES”) WHO ARE OF LEGAL AGE OF MAJORITY IN THEIR JURISDICTION OF RESIDENCE. Employees (and their immediate families (parent, child, spouse or sibling and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related) of Seagate Singapore International Headquarters Pte. Ltd. (“Sponsor” or “Seagate”), its parent company, affiliates, subsidiaries and advertising and promotion agencies or any other individuals or entities engaged in the development, production, or distribution of materials for this Promotion are not eligible to enter or win. By participating, Participants agree to be bound by these Official Rules and the decisions of Sponsor, which are binding and final on all matters relating to this Promotion. Promotion is subject to all applicable federal, provincial, state, territorial and local laws. VOID WHERE PROHIBITED BY LAW.

TO ENTER：Between Jan 1, 2022 at 12:00 AM China Standard Time (GMT+8) and March 31, 2022 at 11:59 PM China Standard Time (GMT+8) (the “Entry Period”), log on to your registered Seagate account at https://returns.seagate.com/ (the “Seagate Returns Landing Page”) and create an order to return eligible retired drives that are no longer in use. If you do not have a registered Seagate account, you will need to create one on the Seagate Returns Landing Page to participate in this Promotion. All entries must be submitted as described herein by March 31, 2022 by 11:59 PM China Standard Time (GMT+8) to be eligible. Participants must follow the instructions provided in these Official Rules and on the Seagate Returns Landing Page and return any Eligible Drive (defined below) to the Seagate Return Center specified below. Upon receiving a returned Eligible Drive, Seagate will conduct a verification process to determine eligibility and send the E-Voucher Giveaway to Participant via email.

ELIGIBLE DRIVES FOR GIVEAWAY

Any retired (no longer in use) Seagate, Maxtor, and LaCie storage drives (“Eligible Drives”) will be eligible for the Promotion subject to the additional requirements set forth in these Official Rules and on the Seagate Returns Landing Page.

SHIPPING COSTS AND RETURN CENTER

Participants must pay all shipping costs for all shipments of Eligible Drives to Seagate. Send your Eligible Drives to the Seagate Return Center (the “Seagate Return Center”) at Rm. 11A, 6F., No. 8, Sec. 3, Civic Blvd., Zhongzheng Dist., Taipei City, Taiwan (R.O.C.) using the carrier of your choice. Please use a method with ability to trace shipment. Seagate is not responsible for shipments for which the carrier cannot provide proof of delivery. Seagate is not responsible for loss or damage during transit.

NO RESPONSIBILITY FOR STORED DATA. You are responsible for saving or backing up data contained in any Eligible Drives before returning the Eligible Drives to Seagate. Seagate will have no responsibility for any stored data on such drives and will have no liability arising out of any damage to, or transfer or loss of stored data. In order to protect your privacy and other interests in any data on an Eligible Drive, you must delete all data from your Eligible Drive before returning it to Seagate. By returning your Eligible Drive to Seagate, You agree to Seagate wiping all the data on the Eligible Drive in accordance with the Seagate returns process as described in the Seagate return policy found at Data Erasure for Returned Products (the "Seagate Return Policy").You also understand that sending an Eligible Drive to Seagate and not deleting all data from the Eligible Drive may result in the transfer of your data to countries that may not offer the same level of data protection as your home country and the deletion of your data on the Eligible Drive, regardless of whether your Eligible Drive is accepted by Seagate for this Promotion. By returning an Eligible Drive, You are representing and warranting that You have all requisite rights to the data on the Eligible Drive necessary to participate in this Promotion.

NO RETURN OF MODIFIED PRODUCTS. Seagate will not accept returned Eligible Drives with nonstandard face plates, nonstandard side rails, adhesive tape, labels, permanent markings, or other residue (collectively, “Modifications”) applied to the Eligible Drives by you or your customers or end users. You will return all Eligible Drives in a standard configuration, after removing all Modifications.

ORDER ACCEPTANCE. Seagate will only accept Eligible Drives in compliance with all applicable laws, statutes, ordinances and regulations and from persons of the legal age of majority in the country, state or province of their residence. All returned Eligible Drives are subject to acceptance by Seagate at Seagate’s discretion. Seagate may partially accept a return of Eligible Drives without accepting the entire return. Seagate may inspect and test any returned Eligible Drives to determine if they are eligible for the Promotion. Seagate may deny any of the following Eligible Drives:

GIVEAWAY:
Each Participant will receive an e-voucher worth NTD 300 (the “e-Voucher”) for every Eligible Drive returned to Seagate (subject to and after the verification process). The e-Voucher is only redeemable as a discount when the Eligible Participant buys a new Seagate or Lacie product from PC Home at https://ecvip.pchome.com.tw/ (the “PC Home Online Site”) The e-Voucher is valid for 3 months after issuance and can be redeemed at . https://ecvip.pchome.com.tw/。Each e-Voucher is redeemable for a single drive purchase, and e-Vouchers awarded for returns of more than 1 Eligible Drive by a Participant cannot be accumulated towards a single drive purchase on the PC Home Online Site.

Participant may not substitute, assign or transfer E-Voucher, or redeem for cash, but Sponsor reserves the right, at its sole discretion, to substitute the e-Voucher (or portion thereof) with one of comparable or greater value in the event the Giveaway becomes unavailable for any reason. The export or re-export of hardware or software containing encryption may be regulated by the U.S. Department of Commerce, Bureau of Industry and Security (for more information, visit www.bis.doc.gov). Values are expressed in Taiwan Dollars.

CONDITIONS IMPOSED ON PARTICIPANTS:. Receipt of the e-Voucher is subject to the express requirement that Participants submit to Sponsor all documentation which may be requested by Sponsor to permit it to comply with all applicable federal, state, provincial, local and foreign tax reporting and withholding requirements. This may require the submission of Participant social security numbers or national identification numbers for tax reporting purposes. All e-Vouchers will be net of any taxes Sponsor is required by law to withhold. All taxes imposed on Giveaways are the sole responsibility of the Participants, regardless of whether taxes have been so withheld. In order to receive a Giveaway, Participants may be required to submit the tax documentation requested by Sponsor or otherwise required by applicable law, to Sponsor or the relevant tax authority, all as determined by applicable law, including, where relevant, the law of the participant’s country of residence. The Participants are responsible for ensuring that (s)he complies with all the applicable tax laws and filing requirements. If a Participant fails to provide such documentation or comply with such laws, the e-Voucher may be forfeited.

OWNERSHIP OF RETURNED DRIVES. All rights to and ownership of the Eligible Drives and any components thereof (“Components”) will become the property of Seagate, and Seagate will have the exclusive right to use the Eligible Drives and Components in any manner in its sole discretion including the refurbishment and resale of the Eligible Drives and/or the Components.

PARTICIPANTS’ PERSONAL INFORMATION: By entering the Promotion, You consent to Sponsor’s collection, use and disclosure of Your personal information to administer the Promotion as described in these Official Rules. For additional details on how Sponsor manages the personal information it collects, please see Sponsor’s Privacy Statement, available at http://www.seagate.com/about/legal-privacy/privacy-statement/. If a Participant has opted-in for future communications, their personal details will be used to provide information regarding Sponsor's products, service offerings and details of future promotions, consistent with applicable law. In the event of an inconsistency between these Official Rules and the Sponsor’s Privacy Statement, these Official Rules shall prevail. Sponsor partners with third parties to administer promotions and may share Your personal information with these third-party partners, who will handle the information according to their own privacy policies. When using the e-Voucher, Your personal information will be subject to PC Home’s privacy policy found at https://ecvip.pchome.com.tw/web/pages/privacy.htm.

RELEASE OF TECHNICAL LIABILITY: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE THE SEAGATE RETURNS LANDING PAGE OR A SEAGATE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Released Parties (as defined below) are not responsible for lost, late, incomplete, inaccurate, stolen, misdirected, undelivered or garbled entries ; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind which may occur, whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Promotion, including, without limitation, errors or difficulties which may occur in connection with the administration of the Promotion, the processing of entries or in any Promotion-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Promotion. Released Parties are not responsible for injury or damage to Participants' or to any other person's computer related to or resulting from participating in this Promotion or downloading materials from or use of the Seagate Returns Landing Page.

GENERAL CONDITIONS: Except where prohibited by local law, by participating, Participant agrees that Sponsor, PC Home and their respective parent, affiliates, subsidiaries and advertising and promotion agencies and all of their respective officers, directors, employees, representatives and agents (collectively, “Released Parties”) will have no liability whatsoever for, and shall be held harmless by Participants against, any liability, for any injuries, losses or damages of any kind to persons, or property resulting in whole or in part, directly or indirectly, from participation in this Promotion including but not limited to any loss or use of data of any returned or Eligible Drives. Persons who tamper with or abuse any aspect of the Promotion or Seagate Returns Landing Page or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. In the event of a dispute regarding entries received from multiple users having the same e-mail account, the authorized subscriber of the e-mail account at the time of entry will be deemed to be the Participant and must comply with these Official Rules. Authorized account subscriber is the natural person who is assigned the e-mail address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning e-mail addresses. This Promotion is governed by the laws of California, United States of America law and is subject to all applicable federal, provincial, state, and local laws. Any and all legal actions or claims arising in connection with this Promotion must be brought in a court of competent jurisdiction in California, United States of America. In the event of an inconsistency or conflict of the terms of these Official Rules with any terms of the Seagate Returns Landing Page or policy, the terms of these Official Rules shall prevail.

RIGHT TO TERMINATE: Should any portion of the Promotion be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Promotion and, if terminated, at its discretion, select Participants from all eligible, non-suspect entries received prior to action taken or as otherwise deemed fair and appropriate by Sponsor.

COUNTRY SPECIFIC NOTICES: If any provision of these Official Rules is invalid under the law, rules or regulations of a particular country, the invalidity of such provision shall not affect the validity of the remaining provision.
